1. Information only — not advice

Market-Sure provides general market information about the UAE property market. Nothing on this site is, or should be taken as, financial, investment, legal, tax, mortgage, valuation, accounting or professional advice of any kind, and nothing constitutes an offer, recommendation, solicitation or inducement to buy, sell, rent, lease, hold or deal in any property or to enter into any transaction. We do not tell you what to do. We are not a real-estate broker, agent, valuer, mortgage broker, financial adviser or legal adviser, and we do not represent you or act on your behalf in any transaction.

2. No reliance — you must verify

You must independently verify all information, figures, estimates and commentary before making any decision or taking (or refraining from) any action. You should carry out your own due diligence and obtain independent professional advice appropriate to your circumstances. Any reliance you place on the content is strictly at your own risk. Property decisions carry significant financial and legal consequences — confirm everything with the relevant authorities, a licensed broker, a qualified lawyer and/or a financial adviser first.

3. Data accuracy & integrity

Information is compiled from third-party and publicly available sources, and is supplemented by automated processing, estimates and AI-generated content (for example indicative sizes, drive times, area analysis, comparable selection and written commentary). Such data and content may be incomplete, out of date, delayed, aggregated, estimated, mis-categorised or inaccurate, and registration and reporting lags mean recent periods in particular may be understated. We give no warranty, representation or guarantee, express or implied, as to the accuracy, completeness, currency, reliability, suitability or fitness for any purpose of any information, and all such warranties are excluded to the fullest extent permitted by law. Figures are indicative only and are not a valuation, appraisal or price guarantee.

4. Third-party data & licences

Some information is derived from open and third-party data sources and is used in accordance with the applicable third-party and open-data licences and terms. Those sources and their licensors do not endorse Market-Sure or its outputs. We grant you no rights in any third-party data beyond viewing it on this site, and you are responsible for ensuring that any further use you make of any data complies with the relevant licences, terms and applicable laws (including data-protection laws). Third-party trademarks and content remain the property of their owners.

5. Limitation of liability

What this section does. This section limits our liability to you. It does not remove any liability that cannot lawfully be removed, it does not prevent you from bringing a claim, and it does not require you to give up any right or remedy the law gives you. If you are a consumer, your statutory rights are unaffected.

The nature of our outputs. Everything on this site is indicative market information — not a valuation, appraisal, survey, audit or professional advice — and we are not a registered valuer, broker or adviser. We accept a duty to prepare that information with reasonable care and skill; we do not accept, and you should not rely on us as owing, the duties of a valuer, adviser or agent.

Your responsibility to verify. Because the information is indicative and must be independently verified (§2), we are not liable for loss that results wholly or partly from your failure to verify, from the decisions you make, or from errors, delays, omissions or mis-categorisation in third-party or open data that we could not reasonably have detected. Where loss is caused partly by you or by a third party, our liability is reduced to that extent.

Losses we do not accept. To the fullest extent permitted by law, Market-Sure, PSmith Management Consulting (IFZA Free Zone, UAE), and their owners, officers, employees, contractors, partners and data suppliers are not liable for any indirect, incidental, special or consequential loss, nor for any loss of profit, revenue, business, goodwill, anticipated savings, opportunity or data, nor for any loss arising from a transaction or decision you make — whether the claim is in contract, tort (including negligence), statute or otherwise, and even if we were advised of the possibility of such loss.

Cap on the losses we do accept. For all other loss, our total aggregate liability to you arising out of or in connection with this site and its information is limited to the greater of (a) the total fees you paid Market-Sure for the report or subscription giving rise to the claim in the 12 months before the claim arose, and (b) AED 5,000. This cap applies to all your claims in aggregate; multiple claims do not increase it.

What we never exclude or limit. Nothing in this notice excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence or wilful misconduct; (d) any liability that cannot lawfully be excluded or limited under UAE Federal Law No. 15 of 2020 (Consumer Protection) and Cabinet Decision No. 66 of 2023, or under any other mandatory UAE law; or (e) the power of a competent court to adjust agreed compensation to the actual loss suffered. If any part of this section is held to be unenforceable, the remaining parts continue in full force.

6. Your responsibilities & indemnity

You agree to use the site lawfully and only for its intended purpose, not to misuse, scrape, resell or misrepresent the data, and to make your own enquiries before acting. You agree to indemnify and hold us harmless against any claim, liability, cost or expense arising from your misuse of the site or data or your breach of these terms, except to the extent it arises from our own fraud, gross negligence or wilful misconduct.

7. Governing law

These terms and your use of the site are governed by the laws of the United Arab Emirates (as applicable to the Emirate of Dubai), and the courts of Dubai have non-exclusive jurisdiction. Nothing in these terms deprives you of the protection of the mandatory consumer laws of your country of residence; where those laws give you greater rights or a right to bring proceedings in your home courts, they prevail.
