Terms of Service
Last updated: 21 July 2026. We may update these Terms at any time; continued use means you accept the current version.
1. Limited licence
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the site and its content for your own internal, non-commercial use (or, for subscribers, the use expressly permitted by your plan). Paid features, data exports and reports are licensed only for the duration of, and to the extent of, an active, paid subscription. No other rights are granted.
2. Prohibited use — no scraping or reuse
You must not, and must not permit any person or automated system to:
- scrape, crawl, harvest, spider, data-mine, bulk-download or otherwise extract data or content by automated means;
- copy, reproduce, store, cache (beyond ordinary browsing), republish, redistribute, sell, sublicense, rent or otherwise make available any content or data to any third party (except as your plan expressly permits, such as issuing a report to your own client under §3C);
- create any derivative database, product or service from the content or data, or use it to build, train or improve a competing product, dataset or model;
- remove, obscure or alter any branding, watermark, attribution or notice;
- circumvent any access control, rate limit, paywall or technical protection, or access the site other than through the interfaces we provide;
- use the site or data in breach of any third-party or open-data licence, or any applicable law (including data-protection law).
3. Subscription & cessation on expiry
Access to paid data, analytics, exports and reports is conditional on a current, paid subscription. Upon expiry, cancellation, suspension or termination of your subscription for any reason, your licence ends immediately and you must cease all use of the data and materials obtained through the subscription, stop displaying, distributing or relying on them going forward, and delete or destroy any copies, exports or derivatives in your possession or control. Continued use after expiry is unauthorised and a breach of these Terms. Branded exports you generated remain subject to these Terms and our attribution requirements.
3A. Broker subscriptions — credits, extra reports & user seats
Broker (Market-Sure+) subscriptions include a monthly allowance of Price Check report credits (Lite 5, Pro 15, Enterprise 50, or as stated on your plan). A credit is consumed each time a report is generated (including a re-run with amended parameters); simply re-viewing a report you have already generated does not consume a credit. The allowance is shared across all users on the account, resets each billing cycle and does not carry over.
Where enabled by the account administrator, reports generated beyond the monthly allowance ("over-allowance reports") are chargeable and are billed to the account's main billing card / payment method. Additional user seats above those included in your plan are charged at the per-seat rate shown at purchase (currently AED 99 per user, per month), billed in advance to the account's payment method and based on the number of seats on the account during the billing period. The account administrator is responsible for all such charges incurred by the account and its users. All prices are stated VAT-inclusive.
3B. Report retention & deletion
We do not keep reports indefinitely. How long a report and its underlying details are retained depends on how far the engagement progressed:
- Reports run but not taken forward. Where a report is generated but you do not sign the relevant terms (for example a no-win-no-fee agreement) or purchase the report, the report and its details are deleted approximately 35 days after it is generated — after our reminder and follow-up cycle has completed and a short grace period has passed.
- Purchased reports. A paid stand-alone report is retained for 24 months from issue, after which it is deleted.
- Signed no-win-no-fee engagements. Where a no-win-no-fee agreement is signed, the report is retained for the life of that agreement and for a reasonable period afterwards to meet our legal, accounting and dispute-resolution obligations, then deleted.
Deletion removes the report and the property details captured for it, including any saved copy of the report served at a shared link (the link will stop working). We may retain limited, non-identifying records (such as transaction and billing logs) where required by law. You may ask us to delete your personal data sooner, subject to our legal obligations.
3C. Broker-branded (“white-label”) reports
Some brokers and agents subscribe to Market-Sure and issue reports to their own clients under their own name, logo or brand (“broker-branded” or “white-label” reports). If you have received a report carrying a broker’s branding, this section explains what you are getting and from whom — it is not written to reduce any right you have.
Who provides what. Market-Sure (operated by PSmith Management Consulting (IFZA Free Zone, UAE)) provides the underlying market data and the analysis model that generate the figures, and remains the technology and data provider behind the report. Your broker or agent — not Market-Sure — chooses to obtain the report, selects the property and parameters, may adjust the figures, and presents the result to you under their brand. Your relationship for that report, and for any service, price opinion, negotiation or advice built around it, is with your broker or agent, not with Market-Sure; Market-Sure does not act for you or represent you. Every report continues to carry a “powered by Market-Sure” credit, which the broker must not remove or obscure.
The same protections apply to you. Branding does not change the nature of the report. Whoever’s name is on it, every figure is indicative market information, not a formal valuation, survey or price guarantee, and is not advice. The information-only, no-reliance, no-warranty, data-accuracy and limitation-of-liability terms in our Disclaimer apply to you as the recipient exactly as they apply to any other user; the broker must not strip, alter or override them.
A price the broker sets is the broker’s. Where a broker sets, adjusts or overrides a price, rent or other figure — or presents a figure that differs from the model’s own evidence-based output — that figure is the broker’s own professional opinion, for which they are responsible. It is not Market-Sure’s valuation, endorsement or assurance, and any accuracy indicator Market-Sure publishes relates only to our model’s own output, never to a figure a broker has changed. A broker must not present our indicative guide as their own formal valuation.
Our methods and brand remain ours. Presenting a report under a broker’s brand is a limited, revocable licence to present the report output only; it transfers no ownership of Market-Sure’s data, model, methodology, software, report templates or the compilation and arrangement of a report (see §4), and does not permit copying, redistributing, reverse-engineering or replicating the tool, the model or the methodology, or using a report to build or train a competing product. The broker is responsible for their own branding, commentary and representations, and indemnifies Market-Sure against claims arising from them; this allocation is between Market-Sure and the broker and does not limit any right you may have against your broker, or any mandatory consumer protection available to you.
4. Intellectual property
The site, its compilation, presentation, analysis, commentary, branding and software are owned by PSmith Management Consulting (IFZA Free Zone, UAE) or its licensors and are protected by law. Underlying data may be sourced from third parties and open-data providers and is used under their licences; those providers retain their rights and do not endorse us. Nothing here transfers any ownership to you.
5. Monitoring, suspension & enforcement
We may monitor use, rate-limit, and use technical measures (including CDN/bot-management and access controls) to protect the service. We may suspend or terminate access, with or without notice, for any actual or suspected breach, and pursue all available remedies. We accept no liability for measures taken in good faith to protect the service.
6. No advice & limitation of liability
The service provides market information only and is not advice. Our Disclaimer (including the limitation of liability, no-reliance and no-warranty terms) is incorporated into these Terms and applies in full.
Live, point-in-time results. Every report and estimate is indicative market context, not a formal valuation, and is a live read off the latest data available to us using the current version of our analysis model (shown on each report as “AVM vx.y”) as at the date the report was issued. New transactions register continually and we periodically improve the model to increase accuracy; accordingly the figures can change between runs, and a report prepared at a later date draws on newer evidence. Such differences reflect updated data and ongoing improvement — they are expected and are not an error, inconsistency or breach of any earlier report. A figure obtained on one date is not a representation that the same figure applies on any other date.
7. Indemnity & governing law
You indemnify us against any claim, loss, cost or liability arising from your breach of these Terms or misuse of the site or data, except to the extent it arises from our own fraud, gross negligence or wilful misconduct. These Terms are governed by the laws of the United Arab Emirates (Emirate of Dubai), and the courts of Dubai have non-exclusive jurisdiction. Nothing in these Terms deprives you of the protection of the mandatory consumer laws of your country of residence, which prevail where they give you greater rights.
